1. Who We Are

TakeScanner is developed and operated by Takemoneys LLC ("we", "us", "Company"). Contact: takescan@takescanner.top.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use TakeScanner on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms and Conditions.

3. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or attempt to extract source code from the app except to the extent permitted by applicable law.
• Use the app to scan, store, or process content you do not have the right to possess.
• Attempt to circumvent in-app purchase mechanisms, license checks, or rate limits.
• Use the app to transmit malware, illegal content, or content that violates the rights of others.
• Resell, redistribute, or sublicense the app.

4. Subscription Terms (Pro)

4.1 Available Plans

TakeScanner offers a free tier and the following optional Pro subscriptions (pricing varies by region and is shown in the app prior to purchase):

• Weekly subscription (with optional free trial)
• Monthly subscription
• Yearly subscription

4.2 Billing & Auto-Renewal

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours prior to the end of the current period at the price of the selected plan.
• You can manage or cancel subscriptions in your iOS device: Settings → [your name] → Subscriptions.
• Any unused portion of a free trial period will be forfeited when you purchase a subscription.

4.3 Refunds

All purchases are processed by Apple. Refund requests must be made directly to Apple at reportaproblem.apple.com and are subject to Apple's refund policies. We do not have the ability to issue refunds directly.

4.4 Free Tier

The free tier provides limited functionality, including a cap on the number of documents and folders and a subset of OCR languages. Feature availability in the free tier may change over time. Pro features are clearly marked in the app.

5. User Content

You retain all rights to the documents you scan, edit, and store using the app ("Your Content"). We do not claim ownership of Your Content. Your Content is stored on your device; we do not access Your Content except as described in our Privacy Policy (e.g., optional AI Summarize feature).

6. Third-Party Services

The optional AI Summarize feature uses OpenAI's API. By using that feature, you also agree to OpenAI's Terms of Use. We are not responsible for the accuracy, completeness, or appropriateness of AI-generated content. You should review AI outputs before relying on them.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF OCR / AI OUTPUT.

We do not warrant that the app will be uninterrupted, error-free, or free of viruses. You use the app at your own risk. You are responsible for maintaining your own backups of important documents.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TAKEMONEYS LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR BUSINESS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR USD $50, WHICHEVER IS GREATER.

9. Apple-Specific Terms (Required by Apple)

• These Terms are between you and Takemoneys LLC only, not with Apple Inc. Apple is not responsible for the app or its content.
• Apple has no obligation to provide maintenance or support for the app.
• In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the app.
• Apple is a third-party beneficiary of these Terms and, upon your acceptance of these Terms, has the right to enforce them against you.
• You represent that you are not located in a country subject to U.S. Government embargo and are not listed on any U.S. Government list of prohibited or restricted parties.

10. Termination

We may suspend or terminate your access to the app at any time if you materially breach these Terms. You may stop using the app at any time by uninstalling it. Provisions that by their nature should survive termination (including Sections 5, 7, 8, 11, 12) will survive.

11. Governing Law

These Terms are governed by the laws applicable to Takemoneys LLC's principal place of business, excluding conflict-of-law rules. Any disputes will be resolved in the courts of that jurisdiction, except where prohibited by applicable consumer protection law.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above and, where appropriate, notifying you in the app. Continued use of the app after changes constitutes acceptance.
